Contract to use Central (UK) Vehicle Leasing Limited’s Website

This website is owned and operated by Central (UK) Vehicle Leasing Limited, whose principal place of business is at 1 Badhan Court, Castle Street, Hadley, Telford, Shropshire, TF1 5QX (referred to as “Central”, “us”, “our” or “we” in this statement) for the information of visitors (referred to as “you” or “your” in this statement) to our website.

Please read these terms and conditions carefully. If you are using our website, you are deemed to have accepted these terms and conditions and thereby have entered into a legally binding contract. Please check these terms and conditions before placing any order as the terms and conditions stated need to be read in conjunction with the order you accept from us. If you disagree with any of our terms and conditions, then please cease from using our website.

You may only place an order with Central if you are at least 18 years old and resident in the United Kingdom.

Central reserve the right to make changes to these terms and conditions from time to time and reserve the right to do so without prior notice.

Website Information refers to the images, applets, scripts, texts and graphics operated by Central. The images used are for illustration purposes only and may not reflect the exact car supplied or model shown.

There is nothing stated on this website and/or on the terms and conditions to allow the use or to copy our website information.

Our Vehicle Information

All vehicles come with a manufacturer warranty. Please note that Central (UK) Vehicle Leasing Limited are NOT liable for any manufacturer changes in models or vehicle specifications. It is the customers responsibility to ensure that the vehicle(s) has the correct specification required. Vehicle information on our website is supplied by a third-party CAP Data and not the manufacturer, whilst we have made every effort to assist in identifying vehicle information and specifications, the information should only be used as a guide. We ask that you please check with the relevant manufacturers for full details of individual specifications for the vehicles to ensure exact requirements are met. Manufacturers websites will provide you with the latest data if you are unsure the Vehicle is suitable.

Central (UK) Vehicle Leasing Limited will not be liable for any loss or damages arising from the use of, or reliance upon, information that may be included on our website – for accurate specification data please consult the manufacturer direct.

Once delivery of the Vehicle has been made, you are responsible for running the vehicle in accordance with the manufacturer’s guidelines – this involves ensuring the vehicle is serviced and maintained.

During the vehicle term and any extended term, the funder / finance company will arrange for the provision of road tax – the Vehicle Excise Duty (VED) and include this into the cost of your contract. If the cost of the VED increases during the term of your contract or extended term, you will be liable to pay the difference in amount.

For pre-registered vehicles sold with the balance of the manufacturer’s warranty, an MOT will be required (at customers cost) 3 years from published taxation point, in line with UK law. If a vehicle is pre-registered, you will be entitled to the balance of the manufacturer’s warranty and roadside assistance cover. In the event that the warranty expires within the contract hire period, you will be liable for any servicing, repairs or breakdown costs, unless a maintenance package is purchased as part of the contract, in which case repair costs may be covered subject to the maintenance terms and conditions.

Stock vehicles refers to cars available in the UK for delivery within approx. 2-4 weeks after receipt of all completed contracts and after any necessary cooling off period has expired. The vehicles may be physical at the dealership, within the dealer group, at the local UK port awaiting transportation to the dealership or abroad and on the way to the local UK port.

Delivery of stock cars are subject to change by the manufacturer, and Central cannot be held liable for any delays caused by the manufacturer or any other circumstances outside Central’s control.

All finance companies have an excess mileage charge which is expressed as pence per mile and will be chargeable at the end of your contract should you go over your contracted mileage, please refer to your contracts for the excess mileage charge, this will also be outlined on your order form when you order your vehicle. The majority of contracts allow you to travel over your agreed mileage amount only charging you the pence per mile stated on your order form, however other contracts have a tiered excess mileage charge and only allow you to travel up to a pre-determined amount before a higher excess mileage charge is applied. You will need to refer to your finance contract for full details of the excess mileage charges applicable and what the cost will be to you.

Please be aware that you do not own the vehicle at the end of the contract.

On a contract hire agreement the finance company is the registered owner and keeper of the vehicle.

It is the customer’s responsibility to insure the vehicle. For further details regarding vehicle insurance, please refer to your finance documentation.

Pricing

The prices shown on our website may be shown inclusive or exclusive of VAT, please note that you will be liable to pay VAT.

Prices quoted for Business Contract Hire exclude VAT. Prices quoted for Personal Contract Hire include VAT.

VAT is applicable at the current rate and should this change between the time placing the order but before delivery of your vehicle then payments will be adjusted accordingly with the new VAT rate.

The prices of the vehicles will be as quoted on our website at the time your order has been submitted. However, if there are any changes that affect the price of your order, you will have the right to cancel your order if these changes are not acceptable. Although we take all reasonable care to ensure the prices are correct at the time when the relevant information was entered onto the system.

Due to the large number of vehicles on our website, it is possible that some vehicles may be incorrectly priced despite our efforts to keep pricing up to date, but this will be communicated to you. We will inform you of any pricing errors and you will have the option to either continue with the order at the amended price or you may wish to cancel. We will never process your order without your instructions to do so and if we are unable to contact you using the details provided, we will treat the order as cancelled.

There may also be occasions where prices for the same or similar vehicle contained in your order has been amended on our website after placing your order. This may be due to rates fluctuating because of manufacturing pricing, adjustments in the finance companies’ residual values, dealer or manufacturer discount levels. Please therefore bear in mind that this does not mean the price for your vehicle order is incorrect, should be changed or you have the right to cancel.

The price advertised for the vehicles include delivery by the dealership to a UK mainland destination.

Road Fund Licence fees (Road Tax) are calculated into the quoted price based on the current rate at point of order. Any increases implemented by the Government or Manufacturer may be passed to the customer in part or in full.

Central reserves the right to change the price either before or after an order is accepted. Central will notify you of such a change and you have the right to cancel your order if the charge is not acceptable without any charges.

Prices on our website are for information purposes only and do not constitute an offer by Central capable of an acceptance by you.

Prices that have been quoted may vary depending upon vehicle colour and availability. The price difference can be due to finance companies setting different residual values on certain paint colours.

For dealer contribution deals, a portion of the initial rental is paid by the supplying dealer and the customer must pay the remaining amount direct to the finance company. The breakdown of such a payment will be visible at the point of order.

If a cashback is offered on any of our leasing deals, this relates to a cash payment paid by Central (UK) Vehicle Leasing Limited to the customer after the vehicle has been delivered and the contract has been set live by the finance company. This amount is intended to be used as a contribution towards the initial rental stated on your contracts. It is the customer’s responsibility to supply bank details (sort code and account number) via email so that this cashback can be done.

There may be a rare instance where our supplier may ask for a deposit, prior to ordering your vehicle. If you were to cancel this may result in the loss of any monies paid subject to the discretion of Central (UK) Vehicle Leasing Limited.

All orders are subject to an administration fee of £150.00 + vat payable, this fee charged by Central is for our services and payable at the time the order is placed to secure your vehicle. All fees are detailed at quoting and order stage for transparency.

Enquiry, Quotation & Credit Search & Ordering Process

You may make an enquiry for the services either via telephone or through our website. We may record the conversation for quality, training and order monitoring purposes. By making an enquiry you agree and acknowledge that you are instructing Us to source a vehicle &/or Pricing to enable you to finance the vehicle.

If you are applying on behalf of a limited company or other form of corporate entity when you make the enquiry you are duly authorised to do so. Refusal to provide any information requested by Us or a third party in relation to the proposed finance of a vehicle as set out in these terms shall result in your application being declined and our services ceasing to be offered to you until such time as you disclose to Us the required information. As part of the enquiry you will be asked to provide Us with various personal data, some of which may be deemed sensitive personal data. You understand and acknowledge that by making an enquiry you require us to make enquiries to funders as to the products and services which are available to you and that they and or we may undertake or arrange credit searches as part of the process.

We will use reasonable endeavours to provide you with a quotation for the finance for the vehicle, the quotation is not a contractual offer. We shall liaise directly with the carefully selected panel of finance and vehicle providers with a view to securing the products and services for you as described in the quotation.

Our website or sales consultant will guide you through the steps you need to place an order with us, it is an expression of interest by you to obtain the vehicle ordered at a price similar to that advertised.

Please note that when an order is placed this does not create a contract between you and Central (UK) Vehicle Leasing Limited to lease a vehicle. Central (UK) Vehicle Leasing Limited must first locate a vehicle matching your requirements, at a price agreed between you and Central. You must enter into a finance agreement with the finance company, the contract to lease a vehicle is between you and the finance company, and this contract is binding when the agreement is signed by you and the finance company. Please note that Central may introduce you to the finance company but is not party to the actual contract. The contract is between you and the finance company.

We may introduce you to our carefully selected panel of finance providers who may then pay us for the introduction, we will not refer you outside of this panel.

The supply of all vehicles is subject to availability. In the unlikely event that the vehicle you have ordered is not available or the funder makes a change to the rental, Central will contact you by email or telephone to confirm if you still wish to proceed with the order or if you are open to any alternatives. If an alternative is not acceptable by you, Central will cancel your order without penalties and refund any monies paid.

After an order is accepted by Central, we will then carry out a credit check on you as part of the application process. If you are applying on behalf of a limited company, you are confirming you have the authority to authorize a credit search in the name of the Company and each Director. The lender reserves the right to decline the finance application.

Your obligation as the customer is to co-operate with us in all matters relating to the services and provide us with such information that we may reasonably require to perform the services.

Under the Distance Marketing Directive regulated credit broking agreements that have not be done in person face-to-face i.e. over the internet or the phone, you have the right to cancel the contract within 14 calendar days, we reserve the right to charge you the administration fee if one was applied to cover all costs and expenses incurred in arranging the credit agreement up to that point. This applies to all personal customers, sole traders and partnerships with up to four partners. For Limited Companies, Limited Liability Partnerships (LLP), Public Limited Company (PLC) and Partnerships with more than four partners we reserve the right to charge the administration fee if the order is cancelled.

In the event that we are unable to locate any vehicles stated on the Order Confirmation at the price stated, or after we start to perform the services, we will inform you of this by email and we will not proceed any further. We will refund the administration fee and any other fees within 14 working days.

Delivery

After you have completed and signed the finance agreement and payment of the administration fee and any other charges, we will arrange delivery of your vehicle to either a home or work business address.

We will provide you with an estimated delivery date of the vehicles once this has been received for the relevant dealer supplying the vehicles or the estimated date provided by the manufacturer. The lead times represent, and estimate based on information provided by our suppliers and do not constitute an obligation to supply the vehicle in the time specified. Whilst we endeavor to ensure that delivery dates are as accurate as possible, delivery dates are subject to change by the manufacturer and delays do occur due to production issues. We will keep you informed of any changes to your estimated delivery date to allow you to make any necessary arrangements as a consequence. Central (UK) Vehicle Leasing Limited have no control over manufacturer lead times and will not accept any responsibility for any losses or inconvenience caused because of a delay from the manufacturer or supplying dealership.

Please note that finance companies have a statutory cooling off period that applies to all vehicles and vehicles will not be delivered until the cooling off period has expired. Central (UK) Vehicle Leasing Limited have no control over the cooling off period so cannot deliver any vehicle until the cooling off period has expired.

Unless otherwise communicated to you the prices advertised for the vehicle includes the cost of delivery by the relevant dealer to your chosen UK mainland destination. Please note that all vehicles are driven to the customers. If you require transported delivery (whereby the vehicle is delivered on a trailer / transporter) this can be arranged but additional charges will apply, please ask when arranging delivery. Please note that depending on the finance company, the delivery mileage may in part or in full count towards your pre-agreed contracted mileage.

Upon delivery it is the customer’s responsibility to check the vehicle and to note any damage or discrepancies on the delivery note, failure to do so may mean that the supplier will not accept any liability for any damages.

Cancellation Policy

Any cancellation of a vehicle will only be acknowledged and acted upon in writing. It is your responsibility to ascertain that the cancellation has been received. If you cancel an order between the point where we have committed to a specific vehicle and delivery, then our policy is to charge a cancellation fee of £300.00 + vat.

You have a legal right to cancel your contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Our rights to cancel: We may have to cancel your contract due to unforeseen circumstances and reasons out of our control. This may be because of availability of key personnel and/or any vehicles in which we cannot provide the service. You will be contacted in the event of this happening. If we do have to cancel your contract and you have paid an administration fee for the services which have not yet been provided to you, we will issue a refund for this amount. We will also return initial payment you, if applicable. If we have begun to provide the services to you, we may cancel the contract for the services at any time for any reason and again the administration fee will be refunded to you.

We may also cancel the contract to perform the services at any time with immediate effect if you fail to pay the administration fee and/or initial payment following our requests to you which would be communicated to you on more than one time. Alternatively, if you break these terms and you do not correct or fix the situation within 7 days of us asking you to do so.

Personal Information – how we may use it.

We will use the personal information that you provide us to and is not limited to provide the services; process your payment for the services; perform a credit check; introduce you to a panel of finance providers for the purpose of entering into a finance agreement and to inform you of similar deals that may be advertised on our website.

You agree that we will / may pass on your personal information to credit reference agencies and finance providers as necessary to perform the services and that such entities may keep a record of any search that they do.

We will not give any of your personal data to any other third party.

Statutory Rights

Nothing in these conditions shall affect your statutory rights.
